Argentina opposition files bills to ban its new citizenship by investment

News, 8 October 2026

Opposition lawmakers in both chambers of Argentina’s Congress have filed bills to ban the citizenship-by-investment (CBI) programme the government priced on 2 October at US$350,000 (a Treasury contribution) or US$800,000 (a government bond). On the same day as the announcement, ten Unión por la Patria deputies led by Agustín Rossi and Kelly Olmos filed bill 5254-D-2026, which would prohibit naturalisation in exchange for payments, investments, property purchases or bond subscriptions, and amend Nationality Law 346. It has gone to the Constitutional Affairs and Population and Human Development committees, per the Chamber of Deputies record.

In the Senate, Jorge Capitanich filed S-1441/26 on 24 August, before the prices were announced. It was referred on 4 September to the Constitutional Affairs, General Legislation and National Economy committees, with no committee report yet, per the Senate record. Per IMI Daily, Página/12 reported a third Deputies bill, from Florencia Carignano and Paula Penacca, on 6 October; its text hasn’t been published.

The two main bills differ on what happens to applicants. Per IMI Daily’s reading of the texts, the Deputies bill would treat applications without a final decision as withdrawn and declare citizenships already granted invalid. The Senate bill would send pending files to the ordinary residence route and keep granted citizenships intact. Neither provides a refund.

What is still unknown. Both bills are in committee, and a law needs both chambers; a presidential veto can only be overridden by two-thirds in each. IMI Daily quotes an immigration lawyer who doesn’t expect them to pass easily under the current government, and an adviser to the programme who calls the challenges “par for the course”. The courts are a separate risk: per IMI Daily, the National Electoral Chamber declared emergency decree DNU 366/2025, which created the investment route, null on 30 June in an individual case, and the government’s appeal to the Supreme Court is unresolved. The Ministry of Economy still says applications open in the fourth quarter of 2026, and no resolution setting the amounts had appeared in the Boletín Oficial by 8 October.

What it means for you: nothing has passed, but this is now a programme with live legislative and court challenges, no published fee schedule and no processed applications. If you are considering it, don’t pay anything before the implementing rules are in the Boletín Oficial, ask any agent in writing what happens to your money if the investment route is repealed while your file is pending, and watch the 2027 election, which could change the majority in Congress.

Over to you: If an agent has pitched you Argentina’s programme, did they say anything about refunds if Congress repeals it? And does anyone following Argentine politics expect these bills to reach a committee vote before the 2027 election?
